2Works Labour Inc. doing business as 2Works. (“2Works”, “we”, or “us”) respects your privacy and is committed to protecting the personal information you provide to us while using or accessing our services, using our website, using our mobile application (the “App”), or by otherwise voluntarily interacting with us. The purpose of this privacy policy is to inform you about our privacy practices, including how we collect, use, disclose and protect your personal information, and the choices you have. This privacy policy relates to all of our activities in Canada (excluding Quebec), unless we have provided you with a separate privacy policy for a particular product, service or activity (the “Policy”). 

We collect certain information about App users as a consequence of use of the App. Please review the Policy carefully. By submitting your personal information to us, by using our website, by using our App, or by voluntarily interacting with us, you consent to our collecting, using and disclosing your personal information as set out in this Policy, as revised from time to time. If you do not agree to this Policy, do not use the App. Your continued use of our website, services, and the App following the posting of any amendment to this Policy and, as applicable, following the dissemination of a notice to inform you of it, constitutes your acceptance of such amendment.

Meaning of Personal Information “Personal information” means recorded information about an identifiable individual. This may include your name, date of birth, mailing address, e‑mail address, telephone number, and other information that identifies you or could reasonably be associated with you. Generally under Canadian privacy laws, personal information does not include business contact information that is solely used to communicate with you in relation to your employment, business or profession, such as your name, position name or title, work address, work telephone number, work fax number or work electronic address. Personal information also does not include information that has been anonymised in accordance with recognised best practices such that it is, at all times, reasonably foreseeable that it no longer identifies you, whether on its own or in combination with other information. 

Your consent to collection, use and disclosure Where appropriate, we collect, use and disclose your personal information with your consent or as permitted or required by law. How we obtain your consent depends on the circumstances and the sensitivity of the information. Consent may be express (for example, by ticking an unticked box or signing electronically) or implied (for example, where you provide information for a clear purpose we have explained), subject to applicable law. We typically seek consent at the time your personal information is collected and, if we wish to use it for a new purpose not previously identified, we will seek your consent before doing so. 

If you provide personal information about another individual to us, you must have their consent to enable us to collect, use and disclose their information as described in this Policy. 

To provide you with access to our website, services, and the App, we may need certain personal information. Without such information, we may not be able to provide our services, including access to the App. You may withdraw your consent to our collection, use or disclosure of your personal information at any time by contacting us using the “Contact Us” section below. However:

· withdrawing consent may prevent us from providing our services, website and App to you, in whole or in part, or prevent those from functioning as intended; 

· before we implement the withdrawal, we may require proof of identity; and 

· even if you withdraw consent, we may continue to use, disclose or retain some information as permitted or required by law (for example, for tax, employment or record‑keeping purposes). 

Personal information we collect The information we collect varies depending on how you interact with us and your relationship with 2Works (e.g., worker, client/business user, website visitor). The categories below may apply to you:

A. Website 

· Visitor Information: If you request information via our website (https://2works.ca and associated sub‑domains), we collect contact details (e.g., name, email). 

· Account Information: If you create an account, request support, leave feedback or otherwise communicate with us, we may collect your name, email address, password, profile photo, date of birth, emergency contacts and any other information you choose to provide. 

· Log and Device Information: We automatically collect, in accordance with applicable law, technical information about your use of the website, including browser type, dates and times of access, pages viewed, IP address, device identifiers, operating system and mobile network information. 

· Cookies/Analytics: See “Cookies, Analytics and Tracking Technologies” below. 

B. App 

· Account Information: If you create an account in the App, request support or communicate with us, we may collect your name, contact details, password and identity authentication data, profile photo, date of birth, emergency contacts and any other information you choose to provide. 

· Work and Suitability Information (workers): Eligibility to work in Canada, prior work experience, skills, education, training, references, licensing/qualifications, hours of availability, shift history, messages and images you send via the App, and worker ratings/reviews. Where lawful and necessary for payroll or identity verification, we may collect sensitive identifiers such as Social Insurance Number (SIN) and government‑issued identification (e.g., passport or driver’s licence). We will request express consent for the collection and use of sensitive identifiers and will use them only for the stated purpose (for example, payroll, tax or identity verification). 

· Employer/Client User Information: Name, role, business contact details, location, billing address and phone number. 

C. Payments

· We use a third‑party payments provider (e.g., Stripe) to process payments. Payment card details are collected and processed directly by the provider and are not stored by 2Works. We may receive limited information about the transaction status necessary for our records (e.g., payment confirmation, last four digits for reconciliation).

D. Other interactions

· If you otherwise interact with us (in person, by phone or email, through social media or otherwise), including when you request information about our services, enter a contest or respond to a survey, we may collect the information you provide (e.g., contact details and the content of your communications). 

Non‑personal information we collect We may collect aggregated, de‑identified or anonymised information that does not identify you. For example, we may aggregate usage data to understand how features are used and to improve our services. We will not attempt to re‑identify anonymised data.

How we use your personal information We use the information we collect to provide, maintain, analyse and improve our products and services, including to:

· Create and administer your account; facilitate your use of the App; and send notifications, confirmations, updates, security alerts, technical notices and administrative messages. 

· Match workers and employers for job roles and facilitate communication between them. 

· Assess worker suitability for job roles and, where appropriate and lawful, verify employability status, conduct reference checks and validate qualifications. 

· Administer and process workers’ compensation matters, payroll and statutory remittances. 

· Provide customer service and technical support. 

· Monitor and analyse trends, usage and activities (in accordance with applicable law) to personalise and improve our website, services and the App. 

· Respond to your comments, questions and requests; and otherwise support your use of the App. 

· Notify you about important changes to the App and applicable terms and policies. 

· Display and publish reviews posted by users and customers, in accordance with our moderation standards. 

· Operate contests, promotions and loyalty initiatives, and to display relevant advertising. 

· Communicate with you about products, services, offers and events offered by 2Works and others, and provide news and information we believe may be of interest to you (subject to your consent where required by law). 

· Detect, investigate and help prevent fraud, abuse, security risks and other unlawful activity, and protect the rights and property of 2Works and others. 

· Enforce this Policy or our Terms of Service. 

· Carry out any other purpose for which consent is obtained, or as otherwise permitted or required by law. 

Automated decision‑making and your rights The App uses ratings/reviews and other signals (for example, attendance history and client feedback) to help match workers and employers and to support platform safety and quality. Ratings may influence the visibility of profiles, suitability for certain roles and, in some cases, wage ranges or incentives.

· Transparency: We disclose that automated factors (including ratings and attendance metrics) may affect matching and opportunities. We do not make solely automated decisions that produce legal effects without appropriate human oversight.

· Human review: You may contact us to request an explanation of a material decision that significantly affects you and to request a review by a person. We will consider additional information you provide and may adjust outcomes where appropriate. 

· Safeguards: We prohibit discriminatory or abusive reviews and apply moderation standards. We may remove or not rely on content that violates our standards.

How we share your personal information We may share personal information as follows or as otherwise described in this Policy:

· With employers/clients to facilitate matching and work: for example, a worker’s name, rating, contact details and relevant work history within the employer’s organisation, as reasonably necessary for the engagement. We limit disclosures to what is needed and require clients to use the information only for hiring/assignment purposes. 

· With our service providers (processors): We engage trusted third parties to provide services on our behalf (for example, hosting, analytics, app delivery, communications, payment processing, security and support). We require service providers to protect personal information, use it only to provide services to us, and to delete or return it when no longer needed. Current categories of service providers include Amazon Web Services, Google Analytics, Google Firebase, Sentry, Codemagic, OneSignal, Supabase, Shorebird, Transistorsoft, Cloudflare and Stripe. · With tax authorities and other government bodies as required by law. 

· With law enforcement or regulators if we believe disclosure is required or permitted by applicable law, regulation or legal process.

· With professional advisers (lawyers, auditors, insurers) subject to confidentiality obligations.

· Business transfers: In connection with a proposed or actual reorganisation, merger, sale, joint venture, assignment or other disposition of all or any portion of our business, we may transfer personal information to a third party as reasonably necessary for the transaction, subject to appropriate safeguards.

· Otherwise with your consent or as permitted/required by law. 

Cookies, analytics and tracking technologies We use cookies and similar technologies to operate and improve our website and App, to understand usage and to personalise content (in accordance with applicable law). Cookies are small data files stored on your device. You can manage cookies through your browser settings. Where required by law (for example, for non‑essential cookies used for analytics or advertising), we will seek your consent before placing such cookies. We use third‑party analytics tools (such as Google Analytics) to help us understand how users interact with our services. These providers may set their own cookies. Retention of personal information We retain personal information only for as long as necessary to fulfil the purposes for which it was collected, to meet our legal or contractual obligations, and to protect our rights, after which it is securely destroyed or anonymised. We maintain an internal retention schedule that takes into account record type (for example, account records, payroll/tax, workers’ compensation, communications, and system logs) and applicable limitation periods. We also maintain records of certain privacy incidents as required by law. 

International transfer and storage of information 2Works is based in Canada and processes and stores information in Canada. Your personal information may also be stored and processed in other countries where our service providers are located (for example, the United States for certain cloud, security and payments services). Laws in those countries may differ from those in your home jurisdiction and may permit access to personal information by foreign governments, courts, law enforcement or regulatory agencies. We take reasonable measures to protect personal information transferred to service providers outside Canada, including through contractual commitments and safeguards. Information security and incident response We implement physical, organisational, contractual and technical security measures designed to protect personal information against loss, theft and unauthorised access, use, disclosure or modification. We restrict access to those with a “need‑to‑know” and apply measures such as encryption in transit, role‑based access, logging/monitoring and secure development practices. 

No method of transmission over the Internet or electronic storage is completely secure. If you believe the security of information you provided to us has been compromised, please contact us immediately. We maintain an incident response process to assess, contain and investigate suspected or actual security or privacy incidents, and we will notify regulators and affected individuals as required by law and/or our contractual obligations. 

Opting out of marketing communications If you no longer wish to receive marketing emails from us, you may opt‑out by clicking “unsubscribe” in any such email or by contacting us. We will process your request as soon as feasible and within the time required by law. Even if you opt‑out of marketing, we may still send you non‑marketing messages about your account, the App or important service updates.

Accessing and updating your personal information We make reasonable efforts to keep your personal information accurate and up to date. You may request access to, or correction of, your personal information in our custody or control by contacting us using the details below. We may need to verify your identity before fulfilling your request. In certain circumstances, we may be unable to provide access to all information (for example, where it contains the personal information of others or is subject to legal privilege), but we will explain the reasons, subject to legal restrictions.

Children’s information Our website and the App are not intended for children under the age of 18. Children under 18 should not use our website or App or provide personal information to us. If you provide us with personal information about a child in connection with our services, you warrant that you have the authority to do so. If we learn that we have collected personal information from a child under 18 without appropriate authority, we will delete that information. 

Third‑party websites and services This Policy applies only to our website, products and services. It does not extend to third‑party websites, products, social media platforms or services. When you provide personal information to such third parties, they will use it in accordance with their own privacy policies. We are not responsible for the privacy practices of such third parties and encourage you to review their privacy policies.

Privacy policy updates This Policy is current as of the “Effective date” below. We may modify or update it from time to time. When changes are made, they will become effective when posted to our website unless otherwise indicated. Where changes are material, we will provide additional notice (for example, in‑App or by email). Your continued use of our website, services and the App after such changes take effect constitutes your acknowledgment of the revised Policy.
